admitted liability. The Court awarded damages for Loss of expectation of life, loss of future earning capacity and dependency
for $19500.00.
In the High Court case of Saki v unrepresented Estates 1984 SILR 146, A single man who was killed in an accident. The
defendants admitted liability. Following the Cheung v Tanda case, he was awarded Damages for loss of future earning capacity,
loss of expectation of life and dependency claim. He was awarded $18000.00. How did the Court make such an awards? The
Court made the following reasoning and calculation.If your relative or dependant dies in a car accident, you take the age of the
deceased. You take the monthly salary of the deceased (if he is working). Assume how many years the deceased should have
been working, reduce it by 4%, and then multiply by 15. You will then have an estimation of the lost of future earnings.
You can also make dependency claim. For example school fees for the children of the deceased, or supporting
of widow after the deceased died.
